Guards add while in stealth

I have been walking to an keep task area, my mate a nightshade went into the keep to assassinate somebody. while i was waiting outside.
he had kill someone, but he went dead because of the guards. After the guards killed him they killed/atack me while beeing stealth far away from them they simply add me and ignore my stealth.
